ORDER
1. Present
Civil Applications have been preferred for condonation of delay of
717 days in preferring First Appeals against the order passed by the
trial Court.
2. Though
served, nobody appear on behalf of the respondents.
3. Having
heard the learned Assistant Government Pleader for the applicants and
looking to the facts and circumstances of the case, it appears that
the judgment and award was passed by the trial Court on 31.3.2005 and
certified copy was applied on 23.5.2007. The same was ready on
23.5.2007 and it was obtained on 14.6.2007. Thereafter, it appears
that some time has been consumed in obtaining or getting opinion from
the office of District Government Pleader and thereafter, it appears
that the files have moved from one department to another department
in thinking process to prefer First Appeals. This thinking process
appears to be true and genuine for condonation of delay.
4. As
a cumulative effect of the reasons stated in the Civil Applications,
there are reasonable reasons for condonation of delay. Even otherwise
also the reasons stated in the Civil Applications are not
controverted by the respondents. In view of the aforesaid facts, the
delay caused in filing First Appeals against the judgment and award
passed by the trial Court, is hereby condoned. Rule is made absolute
with no order as to costs.
5. Registry
is directed to enlist these First Appeals on the board of Admission
on 17.4.2008.
