02/ 26.08.2010 Heard learned Counsel for the
petitioner and learned Counsel for the State.
The informant Amika Yadav petitioned
that some money was withdrawn from his
account from the post office because his
eight days wages of NAREGA was deposited in
the post office and when he went to post
office he came to know that Rs. 800/- was
withdrawn without obtaining his signature.
Though the account was having Rs. 5000/-
balance but the pass-book mentioned only Rs.
70/- balance.
Submission is that the petitioner is a
Mukhiya and he is not at all connected with
the payment under scheme of NAREGA. The
petitioner has not committed any offence and
is a respectable person. The petitioner has
no criminal antecedent. Co-accused who is
Rojgar Sevak namely Satyendra Prasad has been
admitted to bail in Cr. Misc. No.21712 of
2010 on 16.07.2010.

Considering the facts and circumstances
of the case, the above named petitioner is
directed to be released on bail on furnishing
bail bond of Rs. 10,000/- (ten thousand) with
two sureties of the like amount each to the
satisfaction of the learned Chief Judicial
Magistrate/court concerned, Arah in
connection with Sandesh P.S. Case No. 09 of
2010.
