02 21.12.2010 Heard learned counsel for the

petitioners and the learned counsel for the

State.

From the First Information Report and

the order of the learned Court below, it

appears that there is allegation of specific

assault by petitioner nos. 2 and 3 causing

sharp cutting injuries.

Therefore, the petition for anticipatory

bail on behalf of the petitioners nos. 2 and

3 is rejected. They may surrender before the

Court below and move for regular bail, which

shall be considered on its own merits.

So far as petitioner nos. 1 and 4 are

concerned, there is no specific allegation

against them of having assaulted the

informant’s side causing any specific injury.

Therefore, in their respect this

application is allowed. Petitioner nos. 1 and

4 namely, Arviind Kumar @ Arvind Kumar Sah @

Arvind Kumar Gupta @ Arvind Sah, Lachhuman

Sah @ Laxman Sah are directed to appear

before the Court below within four weeks from

today and upon their so appearance the

Court below shall release them on bail on

furnishing bail bond of Rs. 10,000/- (ten

thousand) each with two sureties of the like

amount each to the satisfaction of Chief

Judicial Magistrate, East Champaran at

Motihari in Connection with Dumariya Ghat

P.S. Case No. 7 of 2010, subject to the

conditions as laid down under Section 438 (2)

of the Code of Criminal Procedure.
