Heard learned counsel for the applicant, learned A.G.A. for the State and
perused the record.
Learned counsel for the applicant has contended that applicant is mother in
law of the deceased and there is general allegation against her. It is further
contended that she was residing separately. The applicant is in jail since
24.3.2009.
Learned A.G.A. has contended that the deceased was subjected to cruel
treatment and harassment by the accused persons and there was dowry
demand.
The applicant is mother in law of the deceased and no overt act has been
assigned on her part.
Considering the nature of accusation and the severity of punishment in case of
conviction and the nature of supporting evidence, reasonable apprehension of
tampering of the witnesses and prima facie satisfaction of the court in support
of the charge, the applicant is entitled to be released on bail.
Let the applicant Smt. Rajeshwari involved in case crime no. 145 of 2009,
under section 498A, 304B IPC and 3/4 D.P. Act, P.S. Bisauli, District
Badaun be released on bail on her furnishing a personal bond with two
sureties each in the like amount to the satisfaction of the court concerned.
