Petition for bail.

2. The alleged offences are under Sections 363, 366 A, 376

and 201 of the Indian Penal Code. According to prosecution, a girl

aged 15 years was kidnapped by petitioner and she was subjected

to rape. The incident happened on 28.03.2010.

3. Petitioner was arrested on 12.04.2010 and he is in

custody for the past 45 days. Learned counsel for petitioner

submitted that Annexure 1 is a statement given by victim to the

police and a reading of the same will show that her uncles were

torturing her sick mother and she had persuaded the petitioner to

take her away, since the torture was intolerable and he has not

committed any offence, it is submitted.

4. This petition is not opposed. Learned Public Prosecutor

submitted that he has no objection in granting bail but condition

may be imposed.

5. On hearing both sides, I am satisfied that bail can be

granted on conditions. Hence the following order is passed:

Petitioner shall be released on bail on his

executing a bond for Rs.50,000/- with two

solvent sureties each for the like sum to the

satisfaction of the Magistrate Court concerned on

condition that petitioner shall report before the

Investigating Officer as and when directed.

This petition is allowed.
