It appears that earlier petitioner has been granted bail vide
order dated 22.09.2010 in ABA No. 2962 of 2010 with specific direction
to surrender within ten days. However, due to the circumstances
mentioned in this bail application, petitioner could not surrender by
that time. Accordingly, it is prayed that the petitioner may be granted
bail.
Learned Additional P.P. has not disputed this fact that the
petitioner was earlier granted bail on merit.
Considering the aforesaid facts and circumstance, I allow this
application and direct the petitioner to surrender in the court below by
20.5.2011 and in that event the court below is directed to enlarge the
petitioner, above named, on bail on furnishing bail bond of Rs. 10,000/-
(Ten Thousand) with two sureties of the like amount each to the
satisfaction of Chief Judicial Magistrate, Latehar in connection with
Complaint Case No. 229 of 2009 , subject to the condition as laid down
under section 438(2) of the Cr.P.C.
