ORDER
1. RULE.
Mr.H.L. Jani, learned A.P.P. wavies service of Rule on behalf of the
respondent-State. In the facts and circumstances of the case, this
application is taken up for hearing today.
2. This
is an application preferred by the petitioner with a prayer to modify
the conditions imposed by this Court vide order dated 01.07.2006 in
Criminal Misc. Application No.6800 of 2006.
3. Having
heard learned counsel of both the sides, the conditions No.5(a) is
modified as under:-
?S5(a). The
petitioner is permitted to enter Patan district. Learned advocate
Mr.Pandya states that the petitioner shall mark his presence before
the concerned police station at Radhanpur once in a month in the
first week of every month between 11:00 a.m. and 5:00 p.m. till the
commencement of the trial.??
4. In
view of the modification of condition No.5(a) condition Nos.5(b) and
(d) are deleted.
5. With
these observations, the present application stands disposed of. Rule
is discharged.
