Heard. Reply filed by respondents No.1 to 3 is taken on

record and CM disposed of.

Arbitration Cases No. 82 of 2007 & 83 of 2007

This order shall dispose of Arbitration Cases No. 82 of 2007

and 83 of 2007. It is common ground that disputes have arisen between the

parties which are arbitrable in terms of the arbitration clauses contained in

two arbitration agreements, executed between them. Learned counsel for

the parties submit that the matters in dispute, could be referred for

adjudication to the sole arbitration of Shri B.R.Gupta, retired Addl.

District & Sessions Judge.

Arbitration Case No. 82 of 2007 [2]

In the circumstances, therefore, and keeping in view the

submissions made at the bar, I appoint Shri B.R.Gupta, retired Addl.

District & Sessions Judge, as sole Arbitrator to adjudicate upon the

disputes between the parties in regard to both the agreements referred to in

these two petitions. Parties shall appear before the sole Arbitrator on

21.02.2009. The fee of the Arbitrator is fixed at Rs. 5000/- per hearing per

case subject to a maximum of Rs. 50,000/- in each case. The Arbitrator

shall be free to direct the apportionment of the said fee towards costs and

award the same to the parties suitably.
