                            J U D G M E N T

1. Petitioners submit that by Ext.P7 stop memo, Panchayat has

prevented them from carrying on blasting and removal of granites. It

is stated that on receipt of Ext.P7, petitioners have filed Ext.P9

explanation. However Panchayat has not passed orders thereon as a

result of which they are not in a position to carry on their activities. It

is complaining of the above, the writ petition is filed.

2. The facts show that there is a stop memo issued by the

Panchayat and on receipt of which, petitioners have submitted their

explanation. Therefore, the Panchayat is bound to pass orders in the

matter considering the explanation offered by the petitioner and with

notice to them.

3. The writ petition is therefore disposed of directing the

respondent Panchayat to consider and pass orders in the matter in

the light of the explanation offered by the petitioners by Ext.P9 series

W.P.(C).2732/2010

and with notice to them. This shall be done as expeditiously as

possible, at any rate, within three weeks of production of a copy of

this judgment along with the copy of the writ petition.
