It is pointed out by learned counsel for the petitioner that

subject matter of Gardanibagh P.S. Case no. 606/2004 was challenged

before the Division Bench and the Division Bench has been pleased to

quash the dismissal order of the petitioner.

Accordingly, learned counsel for the petitioner seeks time to

file order of the Division Bench of this court.

In the circumstances, let this matter be listed one week after

puja vacation retaining its position.
