1.0 Present
application is filed by the applicant – convict seeking 20 days’
Temporary Bail on account of sad demise of the grandmother of the
convict. Learned advocate Mr. Poojara for the applicant places on
record a zerox copy of a Note issued by Nishkam Seva Mandal
Sardarnagar Township, working at the Cremation ground, Kotarpur,
Bhadreshwar, Ahmedabad, giving information about necessary entry in
the Death Register of Ahmedabad Municipal Corporation that his
grandmother has expired.
2.0 Earlier,
this Court, by order dated 11th March 2011 in Criminal
Misc. Application No. 3326 of 2011 granted him Temporary Bail for a
period of two weeks on the occasion of his own engagement.
3.0 Rule.
Learned Additional Public Prosecutor Mr. Shah waives service of
process of Rule.
4.0 Learned
Additional Public Prosecutor relied upon the Jail Remarks supplied in
Criminal Misc. Application No. 3326 of 2011. Nothing adverse is
noticed against the convict. Besides, he surrendered in time on
expiry of Temporary Bail granted by this Court.
5.0 Taking
aforesaid facts into consideration, this application is allowed. The
applicant – convict is ordered to be released on Temporary Bail
for a period of 02 weeks from the date of his release, on his
executing a personal bond of Rs.5,000/- (Rupees Five Thousand
only) to the satisfaction of the jail authorities.
5.1 The
convict shall surrender to the jail authorities on expiry of the
Temporary Bail period.
5.2 Rule
is made absolute. Direct service is permitted.
