Heard
learned advocates appearing on behalf of respective parties.
Today,
learned advocate Mr. Joshi for appellant received Demand Draft of
Rs.10,000/- from appellant for handing over to opponent’s learned
advocate Ms. Kapadia. She will accept on behalf of opponent.
I
have considered the fact that the amount of alimony about Rs.6,000/-
per month has been accumulated and total thereof comes to
Rs.85,000/-.
Learned
advocate Mr. Joshi submitted that appellant is able to pay
Rs.10,000/- per month against due amount and recurring amount of
maintenance. He submitted that appellant is not able to make more
payment to opponent.
At
this stage, this Court is considering it that Rs.10,000/- per month
which will be received by respondent is sufficient to maintain
herself. However, let this arrangement may continue for some period
and thereafter, some amount may be increased for monthly payment to
respondent by appellant.
Before
that date, it is directed to appellant to send Demand Draft to
respondent of due amount and recurring amount of maintenance in name
of Hema Sureshchandra Mehta.
Therefore,
matter is adjourned to 9 th
March 2010
to verify whether such amount is received by respondent from
appellant or not.
