Rule.
Learned A.P.P., Ms.C.M. Shah for the respondent no.1 and learned
counsel, Mr.Hardik Brahmbhatt waive service of rule.
This
is a quashing application. The applicant is the original accused. The
respondent no.2 has filed complaint at Annexure-A alleging commission
of offence punishable under Sections 363 and 366 of the Indian
Penal Code. It is stated that the daughter of the complainant
had relation with the applicant and, therefore, she had left her
house. At the relevant time, she was aged more than 17 years but
below 18 year of age. Apparently, issues have been resolved between
the parties. They have decided to close the chapter. The complainant
has assured the applicant that at appropriate time, he would not
object to the daughter’s marriage with the applicant. The complainant
is stated to be present as identified by his Advocate. His affidavit
is taken on record.
Considering
the above aspect of the matter, complaint at Annexure-A is quashed.
Rule is made absolute. Application is disposed of.
