ORDER

Rule.

Mr. P.S. Champaneri, learned Assistant Solicitor General of India
waives service of rule on behalf of the respondents.

The
grievance of the petitioner is that she had made an application for
change in the passport by substituting name of her husband which is
necessary for the petitioner in view of her second marriage as her
first marriage was dissolved. The petitioner had submitted an
application to the respondent No.1-authority for making the change
in her passport by deleting name of her earlier husband Kalpesh
Gohel and by inserting name of her present husband Kamal
Tailor , but the authority without passing even any written
reasoned order has orally refused to make the change in the passport
on the ground that the respondent No.1 authority would not make
change requested by petitioner unless order from the court is
produced.

Having
heard and considering the submissions made on behalf of the parties
and referring the communication dated 21.01.2010 of the respondent
No.1, I dispose of this petition by directing the passport
authority to accept the application of the petitioner along with
relevant documents. The petitioner shall make application and shall
go before the concerned authority between 3.00 p.m and 5.00 p.m.
within a period of two weeks from today. The passport authority will
consider the application within a period of three weeks from the
date of receipt of writ of this Court.

With
the above observations and direction, the petition stands disposed
of. Rule is made absolute to the aforesaid extent with no order as
to costs. Direct service is permitted.
