ORAL
ORDER

1. Rule.

Learned Additional Public Prosecutor Mr.Dabhi waives service on
behalf of the State.

2. Following
aspects are considered:-

2.1 No
direct evidence indicating that the applicant was in the company of
the deceased, but the entire case is based upon circumstantial
evidence.

2.2 No
other act attributed to the present applicant except facilitating
removal of dead body by bringing auto rickshaw.

3. Considering
the above aspects, the application deserves to be allowed and is
allowed. The application is allowed and the applicant is ordered to
be released on bail in connection with Crime Register No.I 23 of 2010
of Ankleshwar City Police Station on her executing a bond of
Rs.10,000/- (Rupees ten thousand only) with one surety of the like
amount to the satisfaction of the lower Court and subject to the
conditions that she shall:

[a] not
take undue advantage of her liberty or abuse her liberty;

[b] not
act in a manner injurious to the interest of the prosecution;

[c] maintain
law and order;

[d] mark
her presence before the concerned Police Station on every Friday
between 9.00 a.m. and 3 p.m;

[e] not
leave India without prior permission of the Sessions Judge concerned;

[f] furnish
the address of her residence at the time of execution of the bond and
shall not change the residence without prior permission of the Court;

[g] surrender
her passport, if any, to the Lower Court, within a week.

4. If
breach of any of the above conditions is committed, the Sessions
Judge concerned will be free to issue warrant or to take appropriate
action in the matter.

5. Bail
before the Lower Court having jurisdiction to try the case.

6. Rule
is made absolute. Direct service is permitted.
