Heard
learned advocate s for the parties and the learned APP for the State.

This
is an application for condoning the delay of 35 days caused in filing
the leave to appeal against the judgment and order passed by the
learned Addl.Chief Judicial Magistrate, Anjar-Kachchh in Criminal
Case No. 44/97 whereby the learned Judge has acquitted the original
accused. The said delay has been sufficiently explained in the
application. This application is accordingly allowed. The delay of 35
days caused in filing the leave to appeal is condoned. Rule is made
absolute accordingly.
