                                  JUDGMENT

Ramachandran Nair,J.

The question raised in the appeal filed by the Revenue pertains

to computation of eligible profit for export exemption under Section

8HHC. This is covered by decision of the Supreme Court reported in

IPCA Laboratory Ltd., v. Deputy Commissioner of Income Tax

[266 ITR 521] in favour of the Revenue. Following the said judgment,

we allow the appeal filed by the Revenue by reversing the order of

the Tribunal on this issue with a direction to the assessing officer to

recompute the eligible exemption by following the decision of the

Supreme Court.
