The main grievance of the petitioner, which has been raised at the
time of hearing of the petition, is that the election of the
Committee of Management of the Society which is to be held on
6th January, 2010 may be postponed as the list of members of the
general body of the Society is not correct.
A preliminary objection has been raised by Sri P.P. Chaudhary,
learned counsel appearing for respondent No.3 that the Court
should not interfere with the election process at this stage.
The records indicate that the elections which are scheduled to be
held on 6th January, 2010 were directed to be held pursuant to the
judgment and order dated 14th September, 209 passed in Writ
Petition No.52164 of 2004. As the election process has
commenced and the elections are to take place tomorrow, it will
not be appropriate for the Court to interfere with the election
process at this stage. The petitioner may challenge the election
before the appropriate Authority after the elections are held.
The writ petition is dismissed subject to the observations made
above.
