Background
1. The Complainant filed his RTI application on 09.08.09 with the PIO, North
Eastern Railway, Varanasi stating that in 1978 he was recruited in June, 1978
as casual labourer for working in the Railways and that on 20.08.1999 a letter
was received by him to appear in a screening test and that he had appeared
in the test. The Applicant stated that he has not received any information
about recruitment till date on the basis of test results . In this connection, he
requested for the names of candidates who appeared for the test and of those
who have been employed during the period1978 to 2008.
2. The PIO replied on 24.10.08 stating that on 20.08.1999 the Applicant was not
called for any screening test and that no letter has been sent to the Appellant
to appear in the test and also that the office does not have any list of
labourers who were employed during the year 1978 to 2008. Not satisfied
with the reply, the Applicant filed a Complaint on 29.12.08 before the
Commission
3. The Bench of Mrs. Annapurna Dixit, Information Commissioner scheduled the
hearing for 24th December, 2009.
4. Mr. D.S. Dariyal, Sr.DMM & CPIO, Mr.I. A. Khan, Sr. Clerk, Mr.S.P.Singh, Sr.
Clerk and Mr. Rajesh Pd., Hd. Ck represented the Public Authority.
5. The Complainant was heard over telephone during the hearing.
Decision
6. The Respondent submitted that the Complainant was provided clarification
about the details of his placement in the seniority list. The Complainant
submitted that he would like to see the seniority list, a copy of which was
then handed over to the Appellant by the Respondent during the course of
hearing . With regard to the Complaint that information provided by the PIO
is incorrect and incomplete, the Commission directs the PIO to allow
inspection of complete files related to the enquiry, promotion etc. by the
Complainant and to provide the Complainant with certified copies of
documents he requires.
