learned counsel for the State to file counter affidavit, today

again the prayer for adjournment for the same has been

made.

Put up this case in the last week of January,

2011, retaining its position, if on that date the counter

affidavit will not be filed then the matter will be disposed of

on the basis of the pleadings made in the writ application.
