              This     petition       has     been   filed    under

Section 482 Cr.P.C. for quashing FIR No.116 dated

11.6.2007 under Sections 406, 498-A IPC, Police

Station, City Mansa.

It has been contended that there was a

matrimonial dispute between respondent No.3,

Kulwinder Kaur and Jitender Singh. FIR came to be

lodged on account of the differences at the instance

of respondent No.2, Ajit Singh (father of respondent

No.3.).

Replies on behalf of respondent Nos.2
Crl. Misc. No. M-20760 of 2008 [2]

and 3 have been filed.

As per the affidavit of respondent No.2,

Ajit Singh, it has been stated that that he would

have no objection if the petition is allowed and FIR

is quashed.

Likewise, respondent No.3, Kulwinder

Kaur has stated that she would also have no

objection if the petition is allowed and FIR is

quashed.

Learned counsel for the respondent-State

has not opposed the quashing in view of the

compromise.

Considering the fact that FIR came to be

lodged on account of matrimonial differences;

differences have been settled by way of compromise

that has been placed on record as Annexure P-3;

complainant, Ajit Singh and his daughter, Kulwinder

Kaur (the alleged victim) have sworn affidavits

supporting the prayer made in the petition, it would

be an exercise in futility if the proceedings are

allowed to continue.

In view of the above, this petition is

allowed.

FIR No.116 dated 11.6.2007 under

Sections 406, 498-A IPC, Police Station, City Mansa,

is hereby quashed.
