Background
1. The Applicant filed an RTI application dt.5.5.09 with the CPIO, DoT seeking
photocopies of his ACR for the period 1997-98 to 2007-2008 as well as the
dates on which DPCs were convened after 10.7.07 along with the minutes of
the DPC meetings held after 10.7.07 and the names of the officers who have
been promoted from JAG to SAG since 28.12.07. The CPIO replied on 22.5.09
providing information with regard to dates on which DPC meeting were held.
He requested the Applicant to deposit Rs.106/- towards supply of 53 pages of
information against points 3 and 4. He, however, denied disclosure of ACRs
u/s 8(1)(j) of the RTI Act. Not satisfied with the reply, the Applicant filed an
appeal dt.12.6.09 with the Appellate Authority. On not receiving any reply,
he filed a second appeal dt. Nil before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for October 15, 2009.
3. Shri R.R. Tiwari, CPIO represented the Public Authority.
4. The Applicant was not present during the hearing
Decision
5. The Respondent submitted that two sets of ACRs are being maintained and
the one kept by him is with the UPSC in connection with a DPC meeting to be
held soon and therefore he had to inform the CGM, Maharashtra Circle, BSNL
vide letter dt.12.10.09 to provide the copies of the ACRs available with him,
to the Appellant. He added that copies of the remaining desired documents
were furnished on 9.7.09. He also added that there was some confusion
earlier about disclosure of ACRs. However, after the Full Bench decision of CIC
he had decided to furnish the same to the Appellant.
6. In view of the above submissions made by the respondent, it is held that
complete information has been provided to the Appellant and the appeal is
accordingly disposed off.
