This Criminal Misc. Application under Section 482 Cr.P.C. has been filed
with the prayer to quash the order dated 27.11.2007 passed by Upper Civil
Judge (J.D.) Vth / J.M., Jaunpur in Crime Case No. 591 of 2007 (Padmawati
Vs. Rakesh), under Sections 147, 323, 504, 506 I.P.C., P.S. Sureri, District
Jaunpur.
Learned counsel for the applicant submitted that on 27.11.2007 even the
accused persons were not present, however, due to absence of the applicant
informant they were discharged without giving proper opportunity. Hence at
least applicant is entitle for last opportunity in the present case.
Issue notice to opposite party no. 2 returnable at an early date.
Till the next date of listing, further proceeding in Crime Case no. 591 of
2007, (Padmawati Vs. Rakesh), under Sections 147, 323, 504, 506 I.P.C., P.S.
Sureri, District Jaunpur shall remain stayed.
