ORDER
Background
1. The Applicant filed an RTI application dt.22.7.10 with the PIO, North Western Railway HQ, Jaipur
seeking the copy of the rule by which recovery had been made from the final bill for the loss in
material and also the rule by which ten per cent penalty had been imposed upon him. Shri Rajeev
Singh, PIO on 22.7.10 transferred the RTI Application to Jaipur Division. The PIO, Jaipur Division
replied on 20.8.10 enclosing the desired information. He also invited the Applicant to inspect the
files, if he so desires. In response to the first appeal dt.9.9.10 (Copy not enclosed), the Appellate
Authority replied on 1.10.10 providing further clarification and also inviting the Applicant to inspect the
records. The PIO vide his letter dt.2.11.10 requested the Applicant to deposit Rs.1264/ towards
supply of 632 pages after the Applicant had inspected the records on 6.10.10 and identified the
documents required by him. Being aggrieved with the reply, the Applicant filed a second appeal
dt.13.2.11 before CIC.
Decision
2. The Commission on perusal of the documents on record and after hearing the submissions of both
sides noted that the Appellant had agreed to inspect the files only on 6.10.10 despite being
requested several times to come for inspection. The Commission therefore, directs the PIO to
provide only 100 pages of the information free of cost to the Appellant and to charge him at Rs.2/ per
page for pages beyond that number. This exercise to be completed by 10.7.11.
3. The appeal is disposed of with the above directions.
