ORDER

1. RULE.

Mr. Mengdey, learned APP wavies the service of rule on behalf of
respondents.

2. By
way of this petition, the petitioner-convict has prayed to release
him on parole leave for a period of four weeks on the ground of death
his sister.

3. Heard.

I have perused the relevant record. The convict is sentenced to
undergo life imprisonment for the offence
punishable under Section 302 of the I.P.C.. The fact about the death
of sister of the convict is not in dispute. In support of his say,
the convict has produced Death Certificate of his sister. The
convict has been in jail for about nine years and his jail conduct is
good. Hence, the petition deserves to be allowed partly.

4. In
the result, the petition is partly allowed. The convict shall be
released on parole leave on his furnishing personal bond in the sum
of Rs.5,000/-(Rupees five thousand only) before the Jail Authority
for a period of TEN DAYS only, from the date of his release.
The convict will surrender before
the jail authority on completion of the aforesaid period
IMMEDIATELY,
failing which it shall be open to the competent Authority to take
necessary actions against the convict. Rule is made absolute to the
aforesaid extent. Direct service is permitted.
