                               JUDGMENT

Balakrishnan Nair,J.

The petitioner is the President of a Charitable Society registered

under the provisions of the Travancore Cochin Literary Scientific and

Charitable Societies Registration Act. The 2nd respondent is the

Secretary of that society. The said respondent expended some

amount for the society for running its day to day business. It was

received by the Treasurer under proper voucher. After working for

sometime, the petitioner submits, the 2nd respondent was absent from

the society and caused to issue Ext.P4 notice claiming an amount of

Rs. 2,46,000/-. It appears she has moved the police also and

thereafter the first respondent, Circle Inspector of Police, is

threatening and harassing the petitioner. In the above background,

this writ petition is filed seeking appropriate directions commanding

the first respondent not to harass the petitioner for her failure to

pay a sum of Rs.2,46,000/- to the 2nd respondent.

2. The learned Government Pleader, upon instructions, submitted

that based on the complaint filed by the 2nd respondent, a crime has

been registered against the petitioner under Section 420 of the Indian

Penal Code and the police is investigating the crime in accordance

with law. This submission is recorded. If the petitioner is aggrieved

by the commission or omission of the police, she may work out her

remedies available under the Codes of Criminal Procedure and Civil

Procedure. The writ petition is disposed of as above.
