ORAL
JUDGMENT

1. The
present Misc.Civil Application has been preferred by the applicant
original appellant-defendant to restore Second Appeal (Stamp) No.181
of 2004, which came to be dismissed for non-removal of office
objections.

2. Mr.Suthar,
learned advocate appearing on behalf of the applicant original
appellant-defendant has stated at the bar that office objections
shall be removed within a period of one week from today.

3. In
view of the above, the present Misc.Civil Application is allowed and
time to remove office objections is granted upto 09/03/2010. On
non-removal of office objections, the Second Appeal shall stand
dismissed automatically without referring the matter to the Court. On
removal of office objections, Registry is directed to notify the main
Second Appeal for admission-hearing on 10/03/2010. Rule is made
absolute accordingly. No costs.
