 ORAL ORDER

Leave to amend.

The petitioner has filed this petition
challenging the notice dated 23.6.2004 issued by the
Vallabh Vidyanagar Com. Co-op. Bank Ltd. The bank has
demanded Rs.2,64,734/- (Rupees Two Lakhs Sixty Four
Thousand Seven Hundred Thirty Four only) in this behalf.
Without prejudice to the rights and contentions of the
parties, the petitioner will pay Rs.50,000/- (Rupees
Fifty Thousand only) to the bank within 15 days from
today.

In view of the same, Notice returnable on 22nd
February, 2005. Status-quo as of today. D.S.
permitted.
