ORAL ORDER

1. This
application has been filed with prayers to delete respondent No.4
from the era of respondents as well as to delete prayer at
paragraph-9(B) in Special Civil Application No.6663/2001.

2. Heard
Mr.Samir B. Gohil, learned advocate for Mr.I.S.Supehia, learned
counsel for the applicant (original petitioner) and perused the
averments made in the application. It is submitted by the learned
counsel for the applicant that the whereabouts of respondent No.4 are
not known at present and the prayer made at paragraph-9(B) of the
above-mentioned petition, which is directed against the said
respondent is also required to be deleted along with the name of
respondent No.4, as his presence in the petition is not necessary for
its adjudication.

3. Having
heard the learned counsel for the applicant and in view of the
averments made in the application, the prayers made therein deserve
to be granted.

4. Accordingly,
the application is allowed. The applicant (original petitioner) is
permitted to delete respondent No.4 from the era of respondents in
Special Civil Application No.6663/2001.
In addition, the applicant is permitted to delete prayer at
paragraph-9(B) made in the above-mentioned petition. The necessary
amendments in the petition be carried out, within a period of one
week from today.

The
application is disposed of, in the above terms.
