: In this writ petition the petitioner has prayed for direction on the
respondents to consider her claim and pass appropriate order.

It has been submitted that the petitioner’s husband Yogendra
Ram, Pump Khalasi-cum-Chowkidar was a daily wage Mazdoor working
with the department for quite a long time. He died in harness on
29.12.2006. The petitioner was Dependant on her husband and as such
after his death she applied for her appointment as a daily wage
Mazdoor, as she had no other alternative source of livelihood and
subsistence, by her representation dated 3.4.2007. Since thereafter the
petitioner repeatedly requested the respondents but no order has been
passed till date.

Learned J.C. to Sr. S.C.I appearing on behalf of the respondents,
submitted that the petitioner being widow of daily wage Mazdoor may
not be entitled to any compassionate appointment, however he
conceded that no order has been passed by the Department on the
petitioner’s representation till date.

Considering the said submissions, this writ petition is disposed of
directing the Engineer In-chief, Minor Irrigation Department, Government
of Jharkhand (respondent No.2) to consider the petitioner’s claim and
pass order in accordance with law within a period of six weeks from the
date of receipt/production of a copy of this order.
