: Heard the parties and with their consent this writ petition is
being disposed of at the stage of admission itself. In this writ petition
the prayer of the petitioner is that though he retired on 31.10.1994 but
the retiral dues amounting to Rs. 1,58000/, the details of which has
been given in Annexure-5 to the writ petition, has not been paid to him
as yet.

By filing a counter affidavit it has been stated in paragraph 5 that
by issue of office order No.3 dated 5th June 2006 a Package Scheme for
the payment of the arrears has been issued by the Corporation and the
case of the petitioner is governed under clause (III) of the said Scheme/
office Order No. 03/2006, wherein it has been stated that other eligible
Ex-employees shall be paid the wage revision arrears in 15 (fifteen)
equal monthly installments after receipt of amount from the
Government of Jharkhand against transfer of residential and non-
residential buildings. It is further stated that as soon as funds are
received from the State of Jharkhand the payment of arrears as per the
said Package Scheme/ office order No.03 of 2006 shall be made to the
petitioner.

In view of the stand taken by the Corporation this writ petition is
being disposed of by giving direction to the Corporation to make
payment of arrears to the petitioner pursuant to the said Package
Scheme/ office order 03 of 2006 as soon as the necessary funds are
received from the Government of Jharkhand.

With this observation and direction this writ petition is disposed
of.
