Heard
learned advocate Mr. Vibhuti Nanavati on behalf of appellant.

In
the present appeal, appellant Insurance Company has challenged award
passed by Motor Accident Claim Tribunal, Godhara in MACP no.
2924/2000 dated 30/11/2007.

Learned
advocate Mr. Nanavati raised contention that before Tribunal, no
summons has been issued in favour of owner and it remained without
issuance of summons. Therefore, he is not appeared.

He
also submitted that during the pendency of claim petition,
Santoshben Suresbhai Kalal died, who was w/o Sureshbhai Kalal and
her name was deleted vide exh 12.

Therefore,
appeal is Admit.
