Heard learned counsel for the petitioner and the learned standing
counsel.
The issue involved in this writ petition is already drawing attention
of this Court in Civil Misc. Writ Petition No.25016 of 2010
wherein the Hon’ble Single Judge after considering the matter has
called for a counter affidavit and granted interim orders. Since the
issue involved is identical, the petitioner herein also entitled to get
the same interim protection.
Connect this writ petition along with writ petition no.25016 of
2010.
Learned standing counsel is granted four weeks time to file
counter affidavit. The petitioner will have three week’s thereafter
to file rejoinder affidavit. List after expiry of the aforesaid period.
Considering the facts and circumstances, till the next date of listing
the order of transfer in so far as petitioner is concerned shall
remain stayed.
