1. Rule.

Mr. RC Kodekar, learned Addl. Public Prosecutor waives service of
notice of rule on behalf of the respondent – State of Gujarat.

2. Having
regard to the facts of the case, the application is taken up for
hearing today.

3. Having
heard Mr. VN Mapara, learned advocate for the applicant and Mr. RC
Kodekar, learned APP for the respondent – State of Gujarat and
on perusal of the averments made in the application, which have
remained uncontroverted, it is seen that the applicant has
sufficiently explained delay of 54 days caused in filing the above
numbered criminal appeal.

4. Since
the applicant has shown sufficient cause for not filing the appeal in
time, we deem it expedient to condone the delay, as prayed for, by
allowing this application.

5. For
the foregoing reasons, the application succeeds and it is accordingly
allowed. Delay of 54 days in filing the above numbered criminal
appeal, is hereby condoned. Rule is made absolute accordingly.
