ORDER
Background
1. The Applicant filed an RTI Application dt.20.4.11 with the PIO, CWM Office, West Central Railway,
Kota. She stated that her father Shri Jeevan Ram is working as Head Clerk and was given promotion
on 1.1.01 and was kept for 17 months on adhoc promotion. She further stated that as per the rules of
the Railway Board, no person is kept for more than four months on adhoc basis. In this connection,
she sought information against eight points relating to her father’s placement in the seniority list.
Shri N.K.Mishra, PIO replied on 21.5.11 enclosing six pages of information. The Applicant filed an
appeal dt.18.6.11 with the Appellate Authority seeking further clarification. Shri A.K.Jataria, Appellate
Authority replied on 11.7.11 stating that information has been provided as available on record and
also clarifying that the transfer of the Appellant’s father was based on his own request. He increased
a copy of the request letter . The Applicant, still not satisfied, filed a second appeal dt.15.7.11
seeking the seniority list of January 2001.
Decision
2. During the hearing, the Respondents submitted that no seniority list was prepared as on 1.1.01 as
sought by the Appellant and that this fact was intimated to the Appellant by the PIO in his reply
dt.21.5.11. He added that in order to satisfy the Appellant they had provided a provisional seniority
list, which they created in the interest of the Appellant while clarifying to the Appellant that the list is
only ‘provisional’ .
3. The Commission after hearing the Respondents noted that no such seniority list as being sought by
the Appellant is available in the records and that the Appellant has already been informed about its non
availability.
4. The appeal is therefore dismissed and the case closed at the Commission’s end.
