Even in the present affidavit, to explain the non appearance of
the counsel, all that has been stated is that ‘for some reason’ the
counsel could not appear to press the petition on 3rd July, 2009
when it was listed before the Court.

Learned counsel for the petitioner prays for and is granted three
weeks time to file yet another better affidavit.
