The
petition was filed for direction on the respondent-University to
ensure that all admissions which are given to the students seeking
admission in the First Year in the Bachelor Degree of Commerce in the
academic year 2011-2012 under the centralised admission system by
the Colleges affiliated with the respondent-University, including
self-financed colleges, are given strictly in the order of merit by
giving all eligible students a fair chance to be considered for
admission to First Year in the Bachelor Degree of Commerce in the
academic year 2011-2012. Further prayer has been made to restrain the
respondent-University from sending any other list or quota to the
colleges affiliated with the respondent University, including
self-financed colleges which would compel the said colleges to grant
any admission in the First Year in the Bachelor Degree of Commerce
in the academic year 2011-2012 under the centralised admission system
outside the merit list.
2. Mr.
SI Nanavati appearing on behalf of the second respondent submits that
there is no centralised admission system prevailing in the University
and, therefore, the relief sought for is vague and general in nature.
3. Mr
Shelat appearing on behalf of the Gujarat University would contend
that admissions will be made in accordance with law on the basis of
merit-cum-choice. In the reply affidavit, the respondent-University
has taken a specific plea that applications are being invited from
those students who have not secured admission as on today. Those who
have secured their admissions have no further right to seek admission
and cannot change their colleges at this stage.
4. In
view of such stand taken by the University, the learned counsel for
the petitioners does not press this petition. The petition stands
disposed of accordingly.
