                             JUDGMENT

The petitioner is the owner of a mini lorry bearing

registration No.KL-7-AQ 1686. It is submitted that the vehicle

has been seized by the first respondent on 20/03/2010 alleging

illegal transportation of river sand. It is the contention of the

petitioner that at the time of seizure of the mini lorry original

pass issued by Panchayat was with the petitioner. This writ

petition is filed seeking for a direction to the respondents to

release the vehicle.

2. If the petitioner moves an application for interim

custody of the vehicle before the second respondent, there will

be a direction to the second respondent District Collector to

consider the application after verifying the documents

produced by the petitioner. Orders regarding interim custody

of the vehicle shall be passed within 7 days from the date of

receipt of a copy of this judgment. It will be open to the

second respondent to impose such conditions as he deems fit

if the vehicle is ordered to be released.

3. There will be a further direction to the District

Collector to pass final orders on the proceedings within a

period of two months after hearing the petitioner and after

assessing various materials produced by him.

The writ petition is disposed of as above. No costs.
