This
appeal has been preferred by the appellants against the order of the
learned Single Judge in the First Appeal arising out of the judgment
rendered in a matter under the Motor Vehicles Act by the Tribunal.

The
question of maintainability of such Letters Patent Appeal under
Clause 15 of the Letters Patent fell for consideration before this
Court in Bajaj Allianz General Insurance Co. Ltd. Ambaben, Wd/o
Sanjaybhai Rameshbhai Vasava in LPA No. 2174 of 2009. A
Division Bench of this Court by judgment dated 14.5.2010 held that
the Letters Patent Appeal against the judgment of the learned Single
Judge rendered in an appeal under Section 173 of the Motors Vehicles
Act is not maintainable. Following the decision aforesaid, we also
dismiss this appeal being not maintainable. No costs.
