Heard Sri H.G.S. Parihar, learned counsel for the petitioner, who has made
compassionate argument that the petitioner who was second senior most
teacher of the College could not participate in the selection held by the U.P.
Secondary Education Services Selection Board as he was out on pilgrimage.
His case is that the D.I.O.S. requested the selection board to extend the date as
the petitioner could not be contacted being out of country and he had no
notice that such a selection is being held. Sri H.S. Jain, Learned counsel
appearing for the Board says that since the dates were fixed on regional basis
and there are several candidates, hence on the request of one candidate for
personal reasons, the dates cannot be changed like this. This is a hard case but
unfortunately there is no mala-fide or carelessness on the part of the opposite
parties. Sri Jain prays for and is granted three weeks time to file counter-
affidavit. Rejoinder- affidavit, if any, may be filed within a week thereafter.
