2 24-10-2011 Heard learned counsel for the petitioner as well as

learned Additional Public Prosecutor for the State.

Earlier prayer for bail of the petitioner was rejected by

this court vide order dated 17-03-2011 passed in Cr. Misc. No.

3431 of 2011 with liberty to the petitioner to renew his prayer for

bail if his trial is not concluded within six months.

The supplementary affidavit contains the order-sheets

of learned court below. It appears from the order-sheet of

learned court below that the trial of the petitioner is still

continuing.

Learned counsel for the petitioner points out that uptill

now, only two prosecution witnesses have been examined

whereas altogether 15 witnesses have been cited in charge

sheet, so, 13 prosecution witnesses are still left to be examined.

It appears from perusal of the order sheets that on 07-

09-2011, two prosecution witnesses had made their

appearance before the trial court but due to non-production of

the petitioner, the aforesaid prosecution witnesses could not be

examined.

Let a report be called for from the court of Shri D.N.

Bhardwaj, Judicial Magistrate-Ist Class, Munger in connection

with Trial No. 494 of 2011 arising out of G.R. No. 1119 of 2010

(Munger Muffasil P.S. Case No. 103 of 2010) and also about

the expected time to be taken for conclusion of aforesaid case.

Let this matter be listed under the heading for

admission immediately after receipt of the above-said report.
