Facts
arising from the Complaint:
The Complainant had filed a RTI application dated 21/02/2011 with the PIO, MCD SP
Zone, seeking certain information. Since the Complainant did not receive any information from
the PIO, he filed a Complaint under Section 18 of the RTI Act before this Commission on
01/06/2011. On this basis, the Commission issued a notice to PIO on 06/06/2011 directing him to
provide the information before 01/07/2011.
The Commission is in receipt of the submissions of the Respondent PIO dated 30/06/2011
stating that the said RTI Application was received in his office on 28/02/2011 and the reply was
provided vide letter dated 15/04/2011 wherein the Complainant was asked to come and inspect the
relevant records and take photocopies thereafter, with respect to points 1, 2 ,3 and 4 of his RTI
application, as the records were voluminous in nature, furthermore with respect to points 5 and 8
the Complainant was asked to deposit requisite fees on account of photocopy charges. However
the Complainant did not inspect the records.
Decision:
The Complaint is allowed.
In view of the aforesaid, the PIO & S.E. is hereby directed to facilitate inspection of the relevant
records to the Complainant, with respect to points 1, 2 ,3 and 4 of his RTI application before
10th September 2011, and provide attested photocopies of documents identified by the
Complainant free of cost upto 200 pages. The Complainant may inspect the requisite records
before 06/09/2011.
The PIO & S.E. is further directed to provide the requisite photocopies of documents with respect
to points 5 and 8 of the RTI application, free of cost to the Complainant by 10th September
2011.
Notice of this decision be given free of cost to the parties.
Any information in compliance with this order will be provided free of cost as per section 7(6) of RTI, Act, 2005.
