ORDER
In
pursuance of the order dated 18th March,2008 passed by
this Court, the present applicant has been presented before this
Court, from concerned jail. The applicant has been enlarged on bail,
on a condition that passport ought to be surrendered before the Trial
Court.
2. As
per the applicant, his passport is not traceable and is lost. The
applicant has filed FIR and the applicant is ready and willing to
give an application before the Passport Authority that his passport
may be cancelled. Such application may be preferred by the applicant
and a direction may be given to Passport Authority that his lost
passport may be cancelled by the Passport Authority, so that the
applicant may be enlarged on bail, as per order dated 14th
August,2007 passed by the Trial Court. As and when, the applicant is
in need of passport, he may apply for fresh passport.
3. In
view of the aforesaid submission of the applicant, the respondents
are hereby directed to receive an application from the applicant for
cancellation of his passport and the respondents will inform the
Regional Passport Office about application for cancellation of
passport of the applicant as well as his FIR for loss of his
passport, so that the passport may be cancelled and the applicant may
be enlarged on bail. This exercise will be completed by the
respondent authority on or before next date of hearing. The presence
of the applicant is now, not necessary. S.O. 16th
April,2008.
