Sri R.K.Pandey has filed caveat on behalf of respondent nos. 1 and 2.
Therefore notice need not be served again.
Learned counsel for the respondent prays for and is granted two weeks’ time
to file counter affidvit. Rejoinder affidavit, if any may be filed two weeks
thereafter.
List this case in week commencing 8th March, 2010.
As an interim measure without prejudice to the right and contention of the
parties the operation of the impugned judgments and orders dated 17.7.2008
passed by learned Judge, Small Causes Court, Bulandshahr and the order
dated 11.12.2009 passed by learned Additional District Judge, Court No. 1
Bulandshahr in Revision No. 19 of 2008 Arban Kumar Vs. Ram Bharose Lal
and another shall remain stayed till the next date of listing provided the
petitioner deposits entire decreetal amount within a period of six weeks from
today. The amount already deposited be adjusted towards the deposit of
decreetal amount. The petitioner is further directed to deposit Rs. 3,500 per
month rent from the date of the judgment of the Rivisional court by 7th day of
each succeeding months. The rent has been enhanced looking into the prime
location of the shop and its area. In case of default payment of rent the interim
oder passed by this Court shall stand vacated.
