ORDER

1. RULE.

Shri Neeraj Soni, learned AGP waives service of notice of rule
on behalf of opponent no. 1.

2. The
present application has been preferred by the applicants-original
petitioners to restore the main Special Civil Application, which came
to be dismissed for non-prosecution vide order dated 04/08/2010 as on
that day though the matter was called out the learned advocate
appearing on behalf of the applicants-original petitioners remained
absent.

3. Having
heard the learned advocates appearing on behalf of the respective
parties and subject to payment of cost, which is quantified at Rs.
2,500/- to be deposited by the applicants with the Registry of this
Court within a period of ten days from today and on assurance by the
learned advocate appearing on behalf of the applicants-original
petitioners that as and when the petition is taken up for hearing he
will make himself available failing which the petition shall be
dismissed for non-prosecution, the present application is allowed and
Special Civil Application No. 5783/2010 is restored to file.
Registry is directed to notify Special Civil Application No.
5783/2010 for admission hearing on 12/10/2010 before the Court taking
up such matters, if the aforesaid amount of cost is paid. If the
aforesaid amount of cost is not paid, in that case, Special Civil
Application No. 5783/2010 shall be dismissed for non-prosecution
automatically without referring the matter to the Court. Rule is
made absolute accordingly.
