Fresh
notice to respondent no.2. Mr. Harin P. Raval, learned Asst.
Solicitor General appearing for the Union of India waives service of
notice for respondent no.2-Principal Secretary, Department of
Agriculture, New Delhi. He requests for time and states that he shall
make submissions on behalf of the Union of India as well as concerned
departments on the next date of hearing. Mr.Vinay Pandya, learned AGP
appearing for the State also needs time to clarify the stand of the
State in view of the nature of prayer made in the petition. So, at
the request of Mr. Raval and Mr. Pandya, the matter is adjourned to
25th March, 2008.

It
is the say of Mr. Raval is that one similar petition being Special
Civil Application No. 4135 of 2008 is pending before the Division
Bench and the finding that may be recorded in that petition may have
some bearing on the present petition. On the other hand, say of Mr.
Abhishek Mehta, learned counsel appearing for the petitioners is that
the present petition is altogether of different nature. So, both the
learned counsel may verify the nature of the petition pending before
the Division Bench of this Court.
