                             J U D G M E N T

The petitioner is working as an Assistant Surgeon in the

Community Health Centre, Koduvally in Kozhikode. His date of

birth is 20.2.1962. The main prayer in the Writ Petition is for a

direction to the respondents to grant relaxation to the petitioner

for admission to the PG Medical Course, 2010. For admission for

PG course in the case of service quota candidates, on completion

of the course, the candidate should have at least five years’

service left before the date of superannuation in the respective

department. The upper age limit is to be reckoned as 30.4.2010.

If the same is implemented, the petitioner will fall short of the

required five years’ service in the department, just by one month.

He will retire from service on 30.3.2017.

2. The petitioner has filed Exhibit P5 representation

before the Government seeking for appropriate orders granting

exemption in the matter. There will be a direction to the 1st

respondent to take a decision on Exhibit P5 within a period of one

month and at any rate before the admission process is over.

The petitioner will produce a copy of this judgment along with a

copy of this Writ Petition for compliance.

The Writ Petition is disposed of as above.
