Background
1. The Applicant filed an RTI application dt.21.11.08 with the CPIO, BSNL,
Fatehpur. He requested for copies of his ACRs from 2005 to 2008 . The
CPIO replied on 17.12.08 denying the information. Not satisfied with the
reply, the Applicant filed an appeal dt.23.12.08 with the Appellate Authority.
The Appellate Authority replied on 7.3.09 upholding the decision of the CPIO.
Aggrieved with the reply, the Applicant filed a second appeal dt.6.6.09 before
CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for August 13, 2009.
3. Mr.Ajay Pal Singh, PIO and Mr.Upendra Kumar, JTO represented the Public
Authority.
4. The Applicant was heard through audio conferencing.
Decision
5. The Commission, after hearing both sides and in the light of the decision of
the Full Bench of CIC passed vide order in Appeal No. CIC/WB/A/2007/00422
dated 19.2.09 and the Supreme Court decision in case Dev Dutt vs. Union of
India & Ors. [(2008)8 SCC 725] , directs the CPIO to provide certified copies
of ACRs to the Appellant by 15 September 2009.
7. The Appeal is disposed off on the above terms.
