Heard Sri I.R.Singh, learned counsel for petitioner and Learned Standing
counsel.
The simplicitor writ of mandamus has been filed by petitioner directing the
District Inspector of Schools, Ballia for the purposes of payment of salary to
petitioner on the post of Class IV as petitioner is working from 22.8.2006.
A vacancy was advertised in the institution of Class IV employee on 7.8.2006.
Applications were invited and petitioner was interviewed and petitioner was
given appointment on the basis of selection made by Selection Committee. As
regards the approval of appointment of petitioner, relevant papers were sent to
District Inspector of Schools with all relevant papers for passing appropriate
orders but the District Inspector of Schools has not passed any order and
sitting over the matter. Hence the present writ petition.
I have considered the submissions made on behalf of parties and have perused
the record.
This writ petition is being disposed of finally directing the respondent No.1
i.e. District Inspector of Schools, Ballia to pass appropriate orders upon
approval of appointment of petitioner for the purposes of payment of salary
on the basis of relevant records sent by Principal of the institution by a
speaking and reasoned order within a period of six weeks from the date of
production of certified copy of this order.
With these observations the writ petition is disposed of.
No order as to costs.
