2/ 27.7.2011 Once the petition was dismissed on account of non

prosecution and by order dated 19.3.2009, the same was directed to

be restored but when it was listed again, no one was appearing on

14.5.2010 and resultantly, the petition was dismissed in default. The

petitioner being habitual defaulter in matters of appearance so as to

prosecuting the petition, desists this court to restore the present

petition.

Restoration petition is dismissed.
